PUWER And Machinery Safety: Why Guarding, Maintenance And Training Still Go Wrong
Work equipment is used in almost every business.
In some workplaces, that means obvious machinery: conveyors, presses, saws, drills, mixers, packaging machines, woodworking equipment, workshop tools, production lines, forklifts and powered access equipment.
In others, it may be less dramatic: ladders, pallet trucks, cleaning equipment, display screen equipment, hand tools, kitchen equipment, lifting accessories or office equipment.
Because work equipment is so common, it is easy for businesses to stop seeing the risk.
The equipment becomes familiar. Operators become experienced. Shortcuts become normal. Guards are removed for convenience. Inspections are missed. Training is assumed rather than checked. Old machinery keeps being used because “it has always been fine”.
That is where PUWER matters.
PUWER is not just about machinery in factories. It is about making sure work equipment is suitable, safe, maintained, inspected where necessary, and used by people who have the right information, instruction and training.
What Does PUWER Mean?
PUWER stands for the Provision and Use of Work Equipment Regulations 1998.
The Health and Safety Executive explains that PUWER places duties on people and companies who own, operate or control work equipment. It also applies to businesses and organisations whose employees use work equipment, whether owned by them or not. The HSE’s overview of the Provision and Use of Work Equipment Regulations is a useful starting point for understanding the scope of the regulations.
In practical terms, PUWER requires work equipment to be:
- suitable for its intended use
- safe for use
- maintained in a safe condition
- inspected where required
- used only by people who have received adequate information, instruction and training
- accompanied by suitable health and safety measures, such as guards, protective devices, controls and warning systems where needed
That sounds straightforward, but many problems arise because businesses assume equipment is safe without actively checking whether it is safe in the way it is actually being used.
PUWER Is Wider Than Many Businesses Realise
Many people hear PUWER and think only of industrial machinery.
That is understandable, but too narrow.
PUWER applies to work equipment in general. That can include machinery, tools, appliances, apparatus, lifting equipment, vehicles, access equipment and other items used at work.
Examples include:
- production machinery
- woodworking machinery
- metalworking machinery
- conveyors
- packaging equipment
- power tools
- ladders and stepladders
- pallet trucks
- forklift trucks
- cleaning machines
- kitchen equipment
- garage equipment
- agricultural machinery
- workshop tools
- office equipment
- hired equipment
- equipment brought onto site by contractors
Some of these items may also fall under other regulations. For example, lifting equipment may also be subject to LOLER. Electrical equipment may raise electrical safety duties. Machinery may involve manufacturer standards, UKCA or CE marking, guarding, interlocking and control system considerations.
But PUWER remains a core duty wherever work equipment is provided or used.
Why Familiar Equipment Can Be Dangerous
One of the biggest risks with work equipment is familiarity.
When people use equipment every day, they can become less alert to the danger. They may know where the sharp edges are, where the pinch points are, what makes the machine jam, and how to get the job done quickly.
That experience can be valuable. It can also be dangerous if it leads to shortcuts.
Common examples include:
- reaching into machinery before it has fully stopped
- removing guards to clear blockages
- bypassing interlocks
- using tools for tasks they were not designed for
- using damaged equipment because “it still works”
- ignoring unusual noises or vibration
- leaving maintenance until a breakdown occurs
- standing on equipment instead of using safe access
- using ladders where a better access method is needed
- allowing untrained employees to “have a go”
The issue is not always lack of knowledge. Often, people know there is some risk but underestimate how quickly things can go wrong.
Machinery injuries can happen in seconds. Crush, entanglement, cutting, shearing, drawing-in and impact hazards can cause serious injury before anyone has time to react.
Safe Equipment Is Not Just About Buying From A Supplier
Businesses sometimes assume that if equipment was bought from a reputable supplier, it must be safe to use.
That is not enough.
The HSE’s introduction to machinery safety explains that the aim of PUWER is to ensure that work equipment is safe to use, regardless of its age, condition or origin. It also makes clear that PUWER places duties on employers and others who control how work equipment is used. The HSE’s page on machinery safety is useful because it reinforces that responsibility does not end with the manufacturer or supplier.
A new machine may be poorly installed, incorrectly adapted, unsuitable for the task or used in a way the manufacturer did not anticipate.
An older machine may have missing guards, outdated controls, poor isolation arrangements or modifications that have never been properly assessed.
A second-hand machine may have incomplete documentation, worn parts, hidden defects or guarding that no longer meets current expectations.
A hired item may still need checks before use.
The employer still needs to make sure the equipment is suitable and safe for the actual work being carried out.
The Problem With CE And UKCA Assumptions
CE or UKCA marking can be relevant, but it should not be treated as a guarantee that equipment is safe in your workplace.
Marking may indicate that the manufacturer has declared conformity with applicable requirements, but it does not remove the employer’s duties under PUWER.
There are several reasons for this.
The equipment may have been modified after supply. It may be used for a different purpose. It may have deteriorated. Guards may have been removed. Operators may not have received suitable training. Maintenance may not be adequate. The working environment may create risks not considered by the manufacturer.
For older equipment, the original marking may not reflect the current condition of the machine at all.
This is why a PUWER assessment should look at the actual equipment, how it is used, and whether the controls remain suitable.
A label or certificate is not a substitute for a practical risk assessment.
Machinery Guarding Is Often Where Things Fail
Machinery guarding is one of the most visible parts of PUWER compliance, but it is also one of the areas where problems are common.
Guards are there to prevent access to dangerous parts of machinery or to stop dangerous movement before someone can reach the hazard.
Dangerous parts may include:
- cutting blades
- rollers
- gears
- belts
- pulleys
- chains
- shafts
- crushing points
- shearing points
- drawing-in points
- rotating parts
- hot surfaces
- moving machine beds or arms
A guard needs to be suitable for the risk.
A fixed guard may be appropriate where frequent access is not needed. An interlocked guard may be needed where access is required for loading, unloading, setting or clearing. Other protective devices may be required depending on the machinery and task.
Problems arise when guards are missing, damaged, poorly designed, easy to bypass, difficult to use, or not suitable for the actual way the task is carried out.
A guard that prevents production from being carried out efficiently may be defeated. A guard that is awkward to remove may not be refitted after maintenance. A guard that does not cover the real danger zone may give false confidence.
Good guarding needs to protect people and work in practice.
Defeated Interlocks And Safety Devices
One of the clearest signs of a weak machinery safety system is a defeated safety device.
This might be an interlock taped down, a guard switch bypassed, a light curtain muted incorrectly, or a two-hand control avoided.
This usually happens for a reason.
Perhaps the machine jams regularly. Perhaps the guard makes cleaning difficult. Perhaps production targets encourage shortcuts. Perhaps maintenance staff bypass the device and fail to reinstate it. Perhaps operators do not understand why the device matters.
The defeated device is the visible symptom. The underlying cause may be poor design, poor maintenance, production pressure, inadequate training, weak supervision or a failure to involve operators when controls were selected.
Simply telling people not to bypass controls may not be enough.
The business needs to understand why the bypassing happens and remove the reason where possible. That may mean improving guarding design, changing the process, addressing machine reliability, improving maintenance access, retraining staff or strengthening supervision.
Emergency Stops Are Not A Replacement For Guarding
Emergency stop buttons are important, but they are not a primary method of preventing access to dangerous parts.
An emergency stop is there for emergency intervention. It is not there to make a dangerous operating method acceptable.
This distinction matters because some businesses rely too heavily on emergency stops as evidence that equipment is safe.
If a person can reach a dangerous moving part during normal operation, the fact that an emergency stop exists nearby may not be enough. The injury may happen before the button can be pressed.
A proper PUWER assessment should consider how people are prevented from reaching danger in the first place.
That may involve fixed guarding, interlocked guarding, hold-to-run controls, two-hand controls, safe isolation, reduced-speed setting modes, presence-sensing devices or other measures suitable to the risk.
Emergency stops should support safety. They should not be used to justify poor guarding.
Maintenance Is A Safety Control
Maintenance is often treated as an operational issue, but under PUWER it is also a safety issue.
Equipment that is not properly maintained can become dangerous.
Guards may loosen. Brakes may fail. Sensors may stop working. Blades may become damaged. Control systems may behave unpredictably. Hydraulic or pneumatic systems may leak. Cables may wear. Ladders may become damaged. Warning devices may fail.
The HSE’s PUWER overview states that equipment provided for use at work must be maintained in a safe condition.
That does not mean every item needs a complex maintenance regime. The level of maintenance should match the risk, the equipment, the manufacturer’s instructions and the conditions of use.
For higher-risk machinery, planned preventative maintenance may be essential. For lower-risk equipment, routine checks may be sufficient.
The important point is that maintenance should be intentional, recorded where appropriate, and followed up when defects are found.
Inspection: When Is It Needed?
Some work equipment needs formal inspection.
Inspection may be required where safety depends on installation conditions, where equipment is exposed to conditions causing deterioration, or where faults could create significant risk.
Examples might include equipment installed in a particular location, access equipment, lifting-related equipment, machinery subject to wear, or equipment used in harsh environments.
Inspection should be carried out by someone competent.
The inspection should be suitable for the equipment and the risk. It may involve visual checks, functional checks, testing of safety devices, review of guards, condition checks, defect reporting and confirmation that previous actions have been completed.
A common weakness is that inspections are carried out but defects are not acted upon.
Inspection without follow-up creates false confidence.
If an inspection identifies a problem, the business needs a clear process for deciding whether the equipment can continue to be used, whether it needs repair, whether it should be isolated, and who is responsible for action.
Training Must Be More Than “Watch Someone Else Do It”
Training is another area where businesses can become too informal.
In some workplaces, new operators learn by watching someone else. That can be useful as part of the process, but it should not be the whole training system.
People using work equipment need adequate information, instruction and training.
That should include:
- what the equipment is designed to do
- what it must not be used for
- the main hazards
- the control measures
- pre-use checks
- safe operating procedures
- what guards and safety devices do
- what to do if equipment jams
- how to isolate equipment where relevant
- cleaning arrangements
- defect reporting
- emergency arrangements
- supervision requirements
Training should be specific to the equipment and the task.
It should also be refreshed when needed, especially after incidents, near misses, changes in equipment, changes in process, observed unsafe behaviour or long gaps in use.
A signature on a training record does not prove competence by itself. The business should be confident that the person can use the equipment safely in practice.
Supervision And Culture Matter
Even good equipment and good training can fail if supervision is weak.
Supervision helps ensure that safe systems are followed, defects are reported, guards are used, shortcuts are challenged and new workers are supported.
It also helps identify when the written procedure does not match the real task.
If supervisors ignore unsafe behaviour, it quickly becomes normal. If managers praise output but overlook risk, employees learn what really matters. If defects are reported but not fixed, people stop reporting them.
Machinery safety is therefore not just a technical issue. It is also a management issue.
A business can have good documentation but still have poor control if supervisors are not engaged and employees do not believe that safety matters in practice.
Older Machinery Needs Particular Care
Many businesses use older machinery safely, but older equipment needs careful assessment.
Older machines may have been built to different standards. Guards may be missing or inadequate. Control systems may be basic. Emergency stops may not be correctly positioned. Isolation arrangements may be poor. Documentation may be missing. Modifications may have been made over many years.
The fact that a machine has been used for years without an accident does not prove that it is safe.
It may simply mean that no one has yet been caught in the wrong place at the wrong time.
A PUWER assessment of older machinery should consider:
- dangerous moving parts
- guarding
- control systems
- emergency stops
- isolation
- stability
- lighting
- maintenance access
- operator position
- noise
- ejection of materials
- hot or cold surfaces
- instructions and training
- previous modifications
- foreseeable misuse
Where improvements are needed, they should be prioritised according to risk.
Modifications Can Create New Risks
Work equipment is often modified over time.
A guard is altered. A conveyor is extended. A machine is integrated into a production line. A control panel is changed. A new jig is added. A process is speeded up. A machine is adapted for a different product.
These changes may seem minor, but they can affect safety.
A modification can introduce new trapping points, alter access requirements, change stopping times, affect control reliability, create unexpected movement or invalidate assumptions made by the original manufacturer.
Before modifying equipment, the business should consider whether the change affects risk and whether further assessment is needed.
After modification, the equipment should be checked before being returned to use.
A sensible change-control process can prevent machinery safety being gradually weakened over time.
Contractors And Hired Equipment
PUWER can also be relevant where contractors use equipment on your site or where your employees use hired equipment.
If contractors bring equipment onto site, the business should consider how their work will be controlled, whether the equipment creates risks to others, and whether site rules are understood.
If your employees use hired equipment, you still need to make sure it is suitable for the task and that employees can use it safely.
Hired equipment should not be assumed safe simply because it came from a hire company. Pre-use checks, instructions, training and suitability still matter.
This is particularly important with access equipment, powered tools, lifting-related equipment, cleaning machines and temporary work equipment.
PUWER And Workplace Transport
Workplace vehicles and mobile work equipment can also fall under PUWER.
This may include forklifts, pallet trucks, site vehicles, ride-on cleaning machines, mobile elevating work platforms and other self-propelled equipment.
Risks may include collision, overturning, reversing, poor visibility, unstable loads, unauthorised use, poor maintenance and interaction with pedestrians.
Depending on the equipment, other regulations may also apply, but PUWER remains relevant to suitability, maintenance, training, inspection and safe use.
The HSE’s 2024/25 fatal injury statistics show that transport and storage accounted for 15 fatal injuries to workers, while manufacturing accounted for 11, and construction accounted for 35. These figures are not all PUWER-related, but they show why work equipment, vehicles and operational risk remain significant concerns across industry.
Common PUWER Failings
PUWER failings are often practical and visible once someone looks properly.
Common examples include:
- missing or damaged guards
- easy access to dangerous moving parts
- defeated interlocks
- poor emergency stop provision
- lack of safe isolation procedures
- inadequate maintenance
- overdue inspections
- poor defect reporting
- operators using equipment without proper training
- equipment used for the wrong task
- old machinery never properly assessed
- unsafe cleaning or blockage-clearing methods
- poor lighting around equipment
- lack of clear instructions
- modifications not risk assessed
- weak supervision
These issues may develop gradually.
A business may not set out to breach PUWER. It may simply fail to notice that safety standards have slipped.
That is why regular review is important.
What A PUWER Assessment Should Cover
A PUWER assessment should consider whether work equipment is suitable, safe and properly managed.
The exact scope will depend on the type of equipment, but a good assessment may consider:
- what the equipment is used for
- whether it is suitable for the task
- who uses it
- whether users are trained and authorised
- whether dangerous parts are guarded
- whether controls are clear and safe
- whether emergency stops are suitable
- whether isolation arrangements are adequate
- whether maintenance is planned
- whether inspections are required
- whether defects are reported and acted upon
- whether cleaning and blockage clearing are safe
- whether the equipment is stable
- whether lighting is suitable
- whether warning signs or instructions are needed
- whether employees could be exposed to ejected materials, noise, vibration, heat, cold or other risks
- whether modifications have affected safety
- whether foreseeable misuse has been considered
The assessment should not be a generic checklist only.
It should look at the equipment in use and consider whether the controls are effective in practice.
What Good PUWER Management Looks Like
Good PUWER management does not have to be overcomplicated.
It usually includes:
- a clear inventory of relevant equipment
- risk-based assessment of higher-risk items
- suitable guarding and protective devices
- safe operating procedures where needed
- planned maintenance
- pre-use checks where appropriate
- formal inspections where required
- clear defect reporting
- training and authorisation
- supervision
- review after changes, incidents or near misses
The system should match the risk.
A small office will not need the same arrangements as a manufacturing site. A workshop with powered machinery will need more detailed control than a business using basic office equipment. A site using forklifts, conveyors, cutting equipment or complex production machinery will need more robust arrangements.
The aim is practical control, not paperwork for its own sake.
What Businesses Should Do Next

Ask:
- what equipment could cause serious injury if something went wrong?
- are dangerous parts properly guarded?
- are any guards missing, damaged or bypassed?
- do operators understand the controls?

- is there a safe way to clean, maintain or clear blockages?
- is equipment maintained?
- are inspections up to date?
- are defects recorded and fixed?
- have modifications been assessed?
- are employees trained and supervised?
- does the written procedure match the way the job is actually done?
This kind of review can quickly identify whether the system is working or whether the business is relying on assumption.
